General terms and conditions

I. Scope

These general terms and conditions apply to all deliveries from Thomas Langnickel-Stiegler, tea seminars & business consulting (hereinafter Thomas Langnickel-Stiegler) to consumers.

A consumer is any natural person who concludes a legal transaction for a purpose that can predominantly not be attributed to their commercial or independent professional activity.

II. Contracting party

The purchase contract is concluded with Thomas Langnickel-Stiegler, owner: Thomas Langnickel-Stiegler, Falkenweg 41, 50829 Cologne. Tax office: Cologne-West, tax number 5223/5173/4127

III. Conclusion of contract

  1. The presentation of the products in the online shop does not constitute a legally binding offer, but merely an invitation to order.
  2. During the ordering process and before the contract is concluded, you have the option of printing out or saving the contract text using the print function of your Internet browser.
  3. The summary in the order overview informs you again in detail about the individual contract components.
  4. By clicking the “Submit order” button, you place a binding order for the goods listed on the order page.
  5. Your purchase contract is concluded when we accept your order by sending an order confirmation by email immediately after receiving your order.

IV. Right of withdrawal

  1. If you are a consumer (i.e. a natural person who places the order for a purpose that cannot be attributed to your commercial or independent professional activity), you have a right of withdrawal in accordance with the statutory provisions.
  2. If you, as a consumer, make use of your right of withdrawal in accordance with section 4.1, you must bear the regular costs of returning the goods.

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The cancellation period is fourteen days from the day on which you or a third party other than the carrier designated by you takes possession of the goods.

To exercise your right of cancellation, you must inform us [enter name of the entrepreneur, address, telephone number and email address] of your decision to cancel this contract by means of a clear statement (e.g. a letter sent by post or an email). You can use the attached sample cancellation form for this purpose, but this is not mandatory. You can also electronically fill out and submit the sample cancellation form or another clear statement on our website (insert internet address). If you make use of this option, we will immediately send you a confirmation of receipt of such a cancellation (e.g. by email).

To meet the cancellation period, it is sufficient that you send the notification of the exercise of the right of cancellation before the cancellation period has expired.

Consequences of cancellation

If you cancel this contract, we will refund all payments that we have received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a different type of delivery than the cheapest standard delivery offered by us), promptly and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged any fees for this refund. We may refuse to refund until we have received the goods back or until you have provided evidence that you have returned the goods, whichever is earlier.

You must return or hand over the goods to us or to (where applicable, the name and address of the person authorized by you to receive the goods must be inserted here) promptly and in any event no later than fourteen days from the date on which you notify us of the cancellation of this contract. The deadline is met if you send the goods before the expiry of the fourteen-day period.

You bear the direct costs of returning the goods.

You only have to pay for any loss of value of the goods if this loss of value is due to handling of the goods which is not necessary to check their quality, properties and functioning.

VI. Prices and shipping costs

  1. The prices stated on the product pages include all price components. As a small business owner in accordance with § 19 UStG no VAT is currently charged.
  2. In addition to the prices stated, we charge shipping costs for physical deliveries. These are clearly communicated to you on the product pages, in the shopping cart system and on the order page.

VI. Delivery

  1. Delivery is by DHL.
  2. The delivery time within Germany is usually up to 3 days. Within Europe (outside Germany) the delivery time is usually up to 7 days. Outside Europe the delivery time is usually up to 4 weeks. We will indicate any different delivery times separately on the product page.

VII. Payment

  1. Payment can be made either via PayPal or in advance.
  2. If you choose to pay in advance, we will give you our bank details in the order confirmation and deliver the goods after receipt of payment.

VIII. Free discount vouchers

  1. Free discount vouchers are issued as a code in written or digital form and grant a one-time discount in percentage form.
  2. Free discount vouchers are valid from the date of issue until the end of the respective promotion. The duration of the promotion period is communicated in text form when they are issued.
  3. Free discount vouchers can be redeemed before the payment process using the corresponding input field. When the code is confirmed, the discount is deducted from the order amount.
  4. Only one free discount code can be redeemed per booking.
  5. If you cancel your order, we will refund the amount you actually paid.

XI. Retention of title

The goods remain our property until full payment has been made.

X. Warranty for material defects

Thomas Langnickel-Stiegler is liable for material defects in accordance with the applicable statutory provisions, in particular §§ 434 ff of the German Civil Code.

XI. Dispute resolution

The EU Commission has created an internet platform for online dispute resolution. The platform serves as a contact point for the out-of-court settlement of disputes concerning contractual obligations arising from online purchase contracts. More information is available at the following link: http://ec.europa.eu/consumers/odr. We are prepared to participate in a dispute resolution procedure before a consumer arbitration board to settle disputes with consumers. The responsible consumer arbitration board is: Universalarbitration board of the Federal Center for Arbitration e.V., Straßburger Straße 8, 77694 Kehl am Rhein, Germany, www.verbraucher-schlichter.de. To settle the disputes mentioned, we will participate in a dispute resolution procedure before this body.
